Posting on behalf of my girlfriend.

Would she be able to claim JSA if she is living with me and out of work? Just wondering if there is a cap on how much a household can earn before JSA is not allowed.

    I cant see a problem as long as she had paid her NI in the last two full tax years.

    She really needs to go and sign on and ask, even if she cant claim she would get NI credits.

    If she has worked for the last two years, she is probably eligible for contributions-based JSA. This lasts for six months and your income makes no difference to it (although if you are on means-tested benefits then her income would affect this).

    Otherwise, she is unlikely to be given income-based JSA since this is means-tested, and your income would prevent her from passing the means test.

    And to add, that if the partner (you) is working 24 hours or more per week then she will not get JSA Income based. If you are working less than 24 hours per week then she may get JSA IB but your income would be deducted from it possibly leaving her with £0.00 JSA per week

    If she has worked she may be entitled to JSA Contribution based for up to 6 months.

    So based on the above she can either apply for
    JSA Income based
    or
    JSA Contribution based

    If she applies for JSA IB the claim also includes a claim for JSA Conts, if she is entitled to conts she will get that no matter what.

    If she applies for JSA Conts then that is all that she is applying for i.e. it is not also a claim for JSA IB.

    So, unless you work 24 hours or more she should apply for JSA IB incase she is not entitled to JSA Conts.

    If you do work 24 or more hours per week.... then she should only apply for JSA Conts as to claim JSA IB is wasting hers/yours and the jobcentre time.
