    Wow, I didn't know you could re-apply after a 6 month period. Crazy indeed.

    However, I'm more concerned about all the stress of a tribunal to be honest. It took me literally days to put together all of my appeal notes and was really hoping they'd overturn the decision in-house.

    On another note, I have received notes back from the neurologists following my latest MRI scan. The results were not good. How do ensure these latest notes are included in the case?

    It's work related activity group, which means apart from a few interviews you are left alone BUT is a bad thing if you are on Contribution based ESA...

    What did the MRI say if you don't mind me asking, I'm a little further down the road with my treatment I may be able to help..
    I always take the moral high ground, it's lovely up here...

    It's work related activity group, which means apart from a few interviews you are left alone

    You can now be put on the work program, if the advisers think it would be of use to you.
    And even compelled to do work, without any limit of time.

    Ninth Anniversary Combo Breaker
    After working 28years and having an accident at work in which i can hardly walk i had my 1st tribunal. Well even with all the medical evidence from hospital and my doctor i was awarded. 6 points even though the nurse wrote a complete load of lies to what i said to her.I appealed about the decision stating that she had twisted around everything i had said to her and at my 2nd appeal the judge and the doctor could not even be bothered to listen to what i had to say and after a full 10mins with them said they would let me know their decision in the post.A week later i received a letter saying i was only awarded 6 points and my esa was stopped as i was fit for work.The only money i can claim for is jobseekers allowance but they said i have to be fit and able to work 16 to 40 hours a week to claim that which i am not.I have wrote a letter to complain about this nurse at my 1st tribunal for twisting everything around i said but i would advise anyone who does go to an assessment to take someone with them or record what is being said because all they are bothered about is the commission they get when they kick people off esa.

    Ok, first, everyone now has the right to ask to have their assessment recorded, and they will be given a copy of the recording at the end of the session.

    Second you have lost your appeal, you have been found fit for work by the DWP. So you can claim JSA as long as you agree to their criteria & be available for work.

    You can make a fresh claim to ESA 6 months after the claim was closed (when it was closed initially the date you started your appeal process. Not the date when it was closed as a result of losing your appeal. And you will be paid on your new fresh claim, and if you fail the medical again you can appeal and be paid on appeal AGAIN.

    You can claim ESA before 6 months if you wish, but you will only get NI credits only and not be paid until 6months from that date or until you pass a medical assessment. OR if your condition is worse or it is a DIFFERENT condition you will be paid on ESA from the start of the new claim even if it is inside 6 months. If it is worse, the med cert needs to say that it has worsened.
