Redundancy question

Hi I was taken on Perm by my company after working here since 08/04/2010 through a temp agency, same role, same team my question is (as we are going through a 90 day consultation at the min) if I am made redundant on 08/04 would I be entitled to a proper redundancy payment or is the 1 months salary?

    You would be entitled to 2 weeks pay (1 week for each year) presuming you are under 41 years of age.

    That would be statutory minimum, have a look at your contract, you may have better terms on there.

    And of course any accrued holiday pay, unless they make you take any holidays before you leave.

    Edit - when were you taken on permanently, it may make a difference.

    Your time as a temp doesn't count towards your service used in calculating any redundancy pay.

    Any statutory redundancy payment would be due only if you had completed two years as a permanent member of staff.

    If you had completed that time, the amount of statutory pay would depend on your age and your weekly pay (the weekly pay in the calculation is capped at £430 so if you earn more £430 would still be the weekly amont).

    Thanks Littlevoice, I wasnt sure about the temp time and the OP didnt say when he was taken on permanently which is why I edited it.

    Ive learned something too.

    As LV says, two years of being directly employed is the requirement for statutory redundancy pay.

    Your company may offer more generous terms than stat pay, but the min for you would be notice period plus any AL not taken before you leave.
