court tomorrow - last min help needed

Hi

we are in court tomorrow (petrified)

but i am reading over all my forms to check they are filled in correct and i am now stressing over little points so wanted to ask advice.

1) any assets - asks if i have any assets in terms of jewellery (i put no but then thought i have my engagement ring does this need to go down here?) has anyone had to give up there ring whilst i appreciate it may be an asset but also has sentimental value.

2) employment - my last day of work is tomorrow but im confused as to whether to put employed or not as when they get the forms i will not be (hence one reason for BR) but i dont want to fill incorrect (can i add notes to the side to explain)

3) i will no longer have any income but it asks all the costs originally i didnt put anything but now thought maybe i should even though OH will pay for 100% of this - what do i do?

    i didnt put my rings etc down. And i was never asked.

  • i shouldnt think you'd count your jewellery as assets unless you have a collection like elizabeth taylor. I hope all goes well for you, will be thinking of you

    1: I would take sundays' advice on this

    2: Add your explanatory notes re your employment - I did this about my future living arrangements and was fine.

    Not sure about number 3, hopefully someone will come along with an answer for you soon.

    Also - best of luck to you for tomorrow, the court really isn't bad at all and will be over very quickly.

The OR is only really interested in high value assets. If your ring is worth more than £1k then it's best to put it on the form.

As of the day you go BR you won't have any income. Fill out the SOA as it will be from that point onwards. Remember, by the time you have your OR interview in a couple or so weeks you won't have much left of your last wages anyway.

    what i dont understand (and sorry if i am being stupid) do i put all my costs down on SOA e.g rent 875 etc even though i will not be contributing and dont earn anything?

    if benefits pay your rent then you should have also listed the amount as income as the two figures will balance each other out.

    You could add that with the price of gold going through the roof, a engagement ring, wedding band and any other stuff if valued as a job lot is actually worth a few quid and if it was sold and the funds paid into the bank the OR would prob want it.

    The reality is i dont think we look at our stuff as assets but i supose it could be.

    Remember that the onus is on you to declare your assets, this is your oportunity to do so, it is quite rare that the OR would take an engagement ring but they can if it is of sufficient value (in fact i have myself on rare occasions in the past), If in any doubt whatsoever then you should declare it and discuss it with the OR

    One thing to point out though is with engagement rings is that if you are not yet married, then the ring is still actually the property of your partner, if you are married then it is now your property

    Molly - you still need to show the OR what it costs you to live. So, yes, put down all joint expenditure and whatever personal expenditure you have. Then just show an income contribution from your partner of exactly the same amount as the total, leaving a zero balance.

  • sorry if i wasnt clear - what i mean is that my husband wages will pay all our outgoings (he is also going bankrupt) but as i dont earn a wage do i put nothing down on my monthly outgoings as i dont pay for anything - he does or do i still list it all? really confused now

    as for the ring i have put it down i would rather declare than not it doesnt have a high value but at least its on the forms
