If the loan was in her name only then the cheque should be in her name only and she can do with it what she likes, having said that I would think legally that the "ex" would be entitled to half.
I am by no means an expert on this and hopefully one of the legal eagles will see the post and advise better.
This is purely my take on it

Then she just banks this in her own bank,if her ex was entitled, then this would be a joint cheque.
Does not matter where the payments were made from, the loan and ppi is only in her name, problem solved.0 -

Why would they refuse to give you a cheque?,if this check comes in joint names i would have thought it has to go into a joint account,i could be wrong, but i don't think it can be paid into a single account?,due to fraud,as the joint named is entitled to 50% of this.0 -

You say "so i am told lol",could it be the cheque will be joint and your partner wants to keep the lot?

Couldn't they refuse to send out a cheque as there is a outstanding debt on the joint account. Why would they refuse to give you a cheque?,if this check comes in joint names i would have thought it has to go into a joint account,i could be wrong, but i don't think it can be paid into a single account?,due to fraud,as the joint named is entitled to 50% of this.0 -

To repeat what amersall has said "why would they refuse"
If as you say the loan was in her name only then the cheque will be in her name only. It's immaterial how or from where the loan was paid.
I received redress in the form of a cheque in my name only despite the fact the loan was paid for from my wife and I's joint account. Because the loan was in my name only.
Thinking about it if I had gone about it without my wife's knowledge I could have kept the lot
:D I didn't and she has spent it
on both of us I might add
