Council Tax Debt - Bailiffs to attend for removal at 4pm

Hi all - I was wondering if someone could help me please.

I woke up this morning to find a hand delivered letter to say that Bailiffs will visit at 4pm to remove my goods and that I must phone to prevent it.

I phoned the Bailiff and he said that the only way he would not take all my things is if I did a walk in posession and paid some money today. Presently I have £1.03 to my name. I told this to the Bailiff and he said then in that case he would just have to come and remove my things.

I know I am a complete idiot for ignoring previous letters - what a plonker, guess I'm paying for it now.

I found the original letter from the debt company and it says I owe:

Debt of: £427.00
Statutory Fee of : £24.50

Total Amount: £451.50

But the Bailiffs letter from this morning says £683.50

I don't understand why there is such a big difference in amounts. I have had one other letter dropped thorugh the door by hand but no more then this and I have never met the Bailiff in person or answered the door.

I am very scared that they are going to be back at 4pm to take our things. They said that they are legally allowed to take my things and will bring the police to make sure they gain entry.

If someone could give me some advice I would be so very greatful please. Thank you

  • Hi, I think you should contact your local C A B and ask for advice. I can't obviously be sure, but it could be a bluff. Either way you need some advice. Help that helps.

Now im pretty sure they cant take anything unless they have already been in and itemised a list of things they are going to take. I also dont beleive they can force their way in if they havent been in previously.

Im sure someone with more knowledge of this will be along very shortly.

I've heard this before too so I've just done a google search and this site has some good information. It also states that a bailiff cannot force their way in, but will try and persuade you to let them in to 'discuss your debts'. It also tells you what they can and cannot take. Have a look:

You had me at your proper use of "you're".

    Hi

I have to go shortly so this is only going to be a short post.

    1. The bailiff is lying. Seriously lying. if he has not already done a walking possession order, he cannot enter your house unless you let him in at 4pm.

It is important that you keep all doors and windows locked.

    2. The reason he wants the WPO are 2-fold
    a) he can then charge you loads of extra fees for the WPO and then attendence fees
    b) he can force you to make arrangments to pay you cannot afford and then come back and bully you when you are unable to sort it out.

Please send pms to hallowitch and Herbie21 who are really good on bailiffs.

Please also ring the NDL or CCCS for advice on bailiff rights, as they guy actually has not rights at all.

    Which firm is this?

do not under any circumstances let this bailiff into your home

boo boo is correct when she says I'm pretty sure they cant take anything unless they have already been in and itemised a list of things they are going to take. I also don't believe they can force their way in if they haven't been in previously.

please go and lock all your doors now the bailiff can walk in however he cant get a locksmith police etc without previously being in your home to levy goods
If you have a car move it now well away from your street

the fees are wrong the most that can be charged at this stage of enforcement is £469.50 today visit fee should £18
