Can I claim back my share of house deposit after my name has been removed from mortga

Hi guys,

Just a quick question.

I bought a house with my ex partner a few years ago, and a few months ago I had my name removed from the mortgage as we split up.

I did not receive a penny of the money that I had put into the house back from my ex.

My name is no longer on the mortgage as I had it removed a few months ago as I wanted to cut all ties with her.

I no longer pay anything for the house, and i havnt lived there for nearly three years.

I just want the deposit that i paid for the house back seen as though the house is all hers now and in her name.

Is this possible?

Can I claim for my deposit back even though I have already taken my name off the mortgage?

I am wondering if I can request for my share of the deposit on the house back now, even though my name has already been removed from the mortgage?

Could I take this to a small claims court, if my ex refuses? What would the chances of me winning be?

Any advice/help appreciated.

  • My name has been completely removed from the mortgage now, how can I check if I am still on the deeds? I do indeed have proof of the payment. I have my bank statement which shows the transfer of the amount to my ex's bank account.

    Check with the land registry as to who owns the property. It will probably cost a couple of quid to download the information (£6?) but it's the quickest way to find out. Link here.

    If you're on the deeds you still own (or part own) the property. TBH, I'm not sure if the small claims court is appropriate. You'll probably need some legal advice. Consult a solicitor. Many will give you half an hour free advice. I doubt you'll need to do everything through a solicitor but it's worth finding out from them the best way to proceed.

    Remember it's not just your share of the deposit that you're potentially entitled to. It's also a share of the equity that the house might have made since you bought it, from purchase up until when you stopped contributing financially.

  • sorry, just one last thing, when I click on the link provided and search for the property it gives me 2 options:
    Tenure: Leasehold Price Paid/Value Stated Data: Yes

    or

    Tenure: Freehold Price Paid/Value Stated Data: No

    It has a box next to each one saying information available, which one is it that I need to click on?

    My name is not on the register, it is just my ex's name, so I have indeed been removed from it.

    So do you reckon I have no chance of getting any money back? I also paid a lot of ground rent fees which I have invoices for...

    See a solicitor. You could also try posting on the house selling board. You've exhausted my (very limited) knowledge!
