Insurance excess query

Hi, I'm hoping someone can offer me some advice here. Had a bump in the car back in October and both parties were at fault. We both started a manouvre at the same time! At the time I had to pay my £350 excess to the garage that repaired my car. If the accident was 50/50 at fault, do I get any of my excess back. I was under the impression that it was gone forever, but a mate reckons I could get half of it back when the insurance claim is sorted.

If the two insurance companies have agreed this is a 50/50 accident then your mate is right and youshould be able to recover 50% of £350.00 ie £175.00 plus 50% of any other expenses such as travel or hire car costs.Confirm the position with your own insurance company and then write to the TP's insurance company.

Your insurers will only deal with it if you have bought the legal expenses/ uninsured losses cover otherwise you will have to deal with it yourself.
It is very straightforward to do however, get the address and reference number of the TPI from your insurers. Write them a letter clearly setting out that your uninsured losses are: Excess £350, Loss of Use, £X, Miscellaneous Expenses £15 etc and then finish with something along the lines of that you expect to receive a cheque for 50% of your losses within 14 days. Any cheque for less than this will be banked without prejudice on an interim basis. Then just include photocopies of your proof (so invoice for the excess, invoice for hire car, taxi receipts etc).All posts made are simply my own opinions and are neither professional advice nor the opinions of my employers
