Need help HSBC Denying PPI

I applied to my bank HSBC where I took out a mortgage in march 2000. My dad recently wrote to them with regards to PPI and they replied with what I thought was a rude letter but they also commented that due to data protection they don't keep records for longer than 5 years and that my file has been destroyed. So I have to show proof of payment for the PPI. I sold the house around August 2010. Surely they must have records or statements of my mortgage as it was paid off less than 2 years ago. Can you give me any advice please? I'm stuck what to do next!!

Some banks are very quick to destroy records these days. There are obviously data protection rules, but the cynical side of me suspects the speed is mostly for their own benefit (having no records makes it easier to reject complaints). One of my lenders still had records going back 17 years.
So stage one is to have a search around (paper and online) and see what documents you still have.
If you can't find any either, then you could try a Subject Access Request (SAR) which obliges them to send copies of all data they hold about you. That might unearth something they've overlooked.0 -
If you were still paying the MPPI two years ago they should definitely still have records. Also if the MPPI was paid monthly it may well show up on your bank statements as a monthly direct debit to the insurer - who should also hold some records for the policy.
I would SAR HSBC anyway.0 -
Why did you dad write to them about your MPPI?
What do you think the MPPI was mis-sold? (HSBC set MPPI up correctly so there should be no set-up issues like there is with other types of PPI)
MPPI doesnt show on any agreements or applications linked to the mortgage. It is a standalone product.Surely they must have records or statements of my mortgage as it was paid off less than 2 years ago.
Mortgage statements are irrelevant as it doesnt appear on those.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.0
