Aktiv Kapital - Help please!

I have just received a letter out of the blue from Buchanan Clark and Wells who state that their clients name is Aktiv Kapital UK Limited. It is entitled Verification Letter.

It says :

Dear Mrs
,

We are trying to contact Mrs ....... ........ with regards to a private matter. We have confirmed your address through a credit link obtained via a credit reference agency as being the same person who previously lived at the address above.

We act on behalf of Aktiv Kapital UK Limited who have instructed us to contact you.

Please contact us on tel: ...... quoting the above reference number and one of our operators will be available to take any relevant details to resolve the matter.

If you believe that you are not our customer, and have no connection with the above referenced client, please contact us as soon as possible on tel....... to enable us to amend our records and remove your address from our file system.

It is clearly meant for me as it states my previous address and also my previous married name which I have not used since 2002 which is when I became divorced. I think I know what it is about. When I divorced, my ex husband agreed to take over the monthly payments for the gas cooker which I kept when we split. I never thought any more about it and just assumed he'd paid them.

In about 2009, I was starting to sort out my finances and obtained a copy of my credit report and saw an unusual debt on there. I phoned someone (can't remember who) but think it may have been the original lenders. I was told that my ex had stopped payments and there was an outstanding amount but as it was so long ago and for only approx £100, the debt had been wiped and I shouldn't worry about it and it would come off my credit file in due course.

So, I have been reading some of the posts on these boards and have noted that people have been advised not to accept responsibility for debts until they are proved but don't know if that applies to me? Also, should I verify that they have the right person as the letter asks me to?

Please help. Any advice gratefully received as I am very worried about this and what to do next. :(

  • I'm not sure exactly when he stopped payments but it would have been 2002.

    In that case, assuming that he didn't acknowledge the debt after that, then it would be statute barred.

    If you need it, then there is a letter in this link to send by recorded delivery.

    They do however seems to be just "fishing" at the moment, so you could hold fire to see if they write again with more details.

    Thank you for your advice. I won't phone them. Surely they will just write again though? I am unsure as to whether to send the letter as that would then confirm my new name to them. Also, although I think I know what it's about, they haven't actually stated that they are chasing money in their letter so maybe it's a bit previous to send just yet? I only hope people won't turn up at the door.

    If it was me I would just wait to see if they write again.

    If they do and they explain what it;s about, then you can decide what to do next.

    Principal Sum: £355.02

    FORMAL DEMAND

    Dear Mrs *****

    We have been instructed by Aktiv Kapital UK Limited to recover an overdue debt, in the sum of £355.02 on their behalf.

    Our clients have informed us that they are unaware of any legitimate reason for non-payment of their account and they would prefer an amicable settlement.

    Please call our 24 hour payment line immediately on ****** to make payment by credit or debit card. Payment is also accepted online at **************

    Should there be any matter that you would like to bring to our attention or if you wish to discuss your financial circumstances in relation to the debt, please call us immediately.

    Yours faithfully

    **********************************************

    Firstly, the amount they are asking for is much higher than was originally left outstanding. Secondly, they are still sending me letters in my old married name which I haven't used in 10 years or so. If I send them a letter as was suggested before, should I sign it in my old married name? I am not sure that it is a good idea to let them know my new name just in case they are thinking of taking this matter to court or something.

    Please advise. I would be very grateful.

    I'd send fermi letter if you are sure it is over 6 years old and is stature barred. The amounts could be silly fee's for letters and calls.
