Refused return

I bought a pressure washer at the weekend and when i unpacked it the hose didn't look as long as i thoght it would be so i took it back to b and q today to get a refund. They said there was a query and went to talk to someone else then came back and said the couldnt refund as the item had been used as they could see scratches on the bottom and it had water in it. i told them it hadnt but they still refused a refund. i said that is how it was when i bought it but basically they said no way and it had been used. i said were they saying i was lying and they said no just that the item was used. to which i asked for an exchange for a new item not the used one they had sold me. thjey just said they couldnt do that cos the item was used. der they sold it me used. what can i do about this?

You need to separate the two issues ....

    1) You have no right to a refund unless the item is faulty, so if the hose is the length it states on the box you can't go any further with that.

    2) If the item was used prior to you buying it, then you need to concentrate on that. Of course getting them to accept it wasn't you who used it is the difficult part.

That simply isn't the full story.

There is not statutory right to a refund unless the thing is faulty.
However, a contractual right may well have been established where B&Q state something like "if you change your mind within nn days of purchase, bring it back for a refund".

OP, no idea how you might go about getting a refund.
Was the box sealed when you bought it?
If so, it is unlikely that the item had scratches on the base at the time it was sold.

Unfortunately, there are people out there who would buy a pressure washer, take it home to clean their patio and then try and return it for a refund.
Sadly, this sort of thing makes it difficult for the rest of us.

Lots of new products that use water have water still in them when you open them, doesn't mean they are used its just the testing process

The receipt say you can return it within 45 days. The box was sealed with clear tape and must have been revealed after someone took it back.

Doesn't help with the scratches but...

Having previously working in the DIY retail sector for 19 years, ALL new pressure washers have little water in them from when they do a pressure test at the factory.

Take it back to another B&Q's, just make sure it's packed properly.
  • just return it to another b & q store and state that when you opened it, it had scratches on and had a small amount of water left in it so you believe it may well have been previously used so you would like to exhange it. hopefully they will exchange then or you should be able to get a refund.

Yep all Karchers are tested at the factory so that explains the water !
