So what will you sue him for? The sum value of both the cars invovled can't be more than a couple of hundred quid, even if they were faultless.

If he lied to you, and you have the emails, you have a very good case.
The car should be as represented.
    Good luck.

Hang on, you said he got the car from a guy before who had spent money on it to get it through the MOT.

In other words the guy you bought it from did not put it through the MOT so he would not have known about the MOT advisories.

Unless you just didn't write it very well. and it was him. Did you ask him for the advisory list before you swapped the cars? Did you do this conversation by email?
  • In future don't swap your car when someone offers you a swap. Usually when someone offers a swap it is because their car is knackered.

Loads of swaps wanted in my area on Gumtree and you can tell they are sheds they are trying to get rid of.

You might be able to bluff him into giving you your car back, by telling him you will be taking him to court Unless he swaps them back again.

In reality I think you have very little chance of successs, and he might know that aswell, but if he doesn't, then he might back down and swap the cars to get rid of you.

However, if you asked for the advisories before swapping and you have a record of that conversation then you might have a good case against him.

You were very silly to buy a car without taking it for a proper test drive, and without someone who knows what to look for. Of course, cars that old are very likely to have "end of life" problems anyway, so I'm not sure what you were expecting.

He might also be the type of person who has no money, no assets, so you win in court and he laughs at you because you can't enforce the court order against him.

Depending on how long ago this was both of you are probably still waiting for your new V5 from DVLA so if he agrees to swap back, get him to sign a declaration in writing that he is doing this swap and then exchange keys and cars straight away, don't wait for the V5, when the V5 comes then you both sign the V5.
