House buying in scotland

Hi there,

I was having a talk with my friend about house selling (currently getting own house ready for selling & will be looking for a new house). I thought if you bought a house in Scotland, once you put in an offer, that was it, you couldnt back out without being penalised, however, my friend was telling me that she has heard of people backing out after they have agreed a sale. She said if the missives (sp) havent been signed, they can still back out!

Does anyone know if this is correct?

    you can make an offer, subject to survey and then withdraw it if something comes us you don't like. once missives are signed I think this is when it is legally binding so sellers will try to get all signed asap.
