Got a letter from the redundancy payment people?

I got a questionnaire from them, it asks various things, like am I working now, am I related to my previous employer, If I am working now is it in the same address as you old employer is the name company the same, does it have the same directors etc etc, same customers.

Now obviously as I am not working I answer no. But as I mentioned before my previous employer has started back up again hiring back 90% of the staff, name etc are all still the same, so if my co workers fill in all this info they will see the company effectively back in business after being made insolvent and thus not pay my redundancy, would I be right? My thinking is they have got wind of this and are investigating.

    I may be didn't word that very well, so here it is

    Are you working now Y / N

    If yes is at at the same address as your previous employer Y / N

    Are the management the same Y / N

    Are the customers the same Y / N

    And it goes on

    As the old company became insolvent, then restarted, it will be an entirely new entity (as in 'no previous debts or liabilities carried-over'). As such, the Redundancy payment people should pay-out. It is just a formality. Your former colleagues will get their redundancy as well.

    Not if they can show this should have been a TUPE situation.

    Public funds should not be paid automaticaly to cover employee liabilities of phoenix companies using "friendly" administrators where there is a clear case for a TUPE.
