Financial Ombusman cant help :(

I have recieved a letter today in regards to my complaint of PPI. It reads
We are unable to investigate your complaint about The Personal Loan Centre. This is because the event you have complained about (the sale of your PPI) took place on a date before the sale of insurance policies by this firm became covered by our jurisdiction.

They go on to say they have not been able to identify the underwriter and to send further documentation. Problem is i dont have any. Anyone else had this problem?

    yes lots.

    If the case is pre-regulation and there was no applicable regulator for that firm in the area of insurance then it is end of the road as far as your complaint is concerned.

    There are some potential areas where the insurer could be liable if the seller was an agent of the insurer but that does not appear to be the case here as the firm would have referred the complaint on to them.

    I note that The Personal Loan Centre was your broker who arranged the loan, but who was the lender who you paid the payments too?
    You could contact them and ask them to send you details of the loan, and policy and details of the underwriter/insurer are enclosed on them.

    They should send you a copy of the policy details free of charge, and yes many on here have been in the same situation.

    Hi, it was Halifax. I went into Halifax to sign for the loan and it was at that meeting they suggested that it would be a good idea to take out PPI incase either me or my usband lost our jobs or was taken ill. However when i tried to claim for a knee injury they stated as i had previously injured the same knee, even though it had fully heeled they would not withhold the claim.

    At the very same meeting we also took out a credit card (after they asked us if we wanted one) and again we were advised to do take out PPI. Halifax paid back our PPI on the credit card last year with no real problems. However when trying to claim for the loan they stated that it was not them that sold the policy but the personal loan centre who i had originally contacted to obtain a loan.
    I cant understand how they can say it was the Personal Loan centre who sold the policy when it was a halifax staff member who sat us down to sign the paperwork. And they have paid out for the PPI on the credit card, why should the loan be different, surley a broker just gets a fee for organising a new client, its not them i paid the loan to it was Halifax.

    Halifax used to operate a lot of agencies which were based in the offices of solicitors, brokers and advisers. Was it a real Halifax branch or was it an agency office?

    There is absolutely nothing wrong with having PPI. You are not complaining about the product. You are complaining about how it was sold or set up. When a broker is used, the broker carries the liability for the advice and sale. Not the company the loan or PPI is placed with (unless they are an agent for that company).

    Halifax have been auto paying out on PPI claims for a while as they deal with their backlog. So, the fact you got paid out on one doesnt mean you were entitled to it. You could have just got lucky. It has no impact on decisions made by others. Also, your complaint reason is very weak. it would be very easy to reject the complaint if that was your only reason.
