PCN Code 30

I parked in a bay where the restrictions were 1 hour parking and no return within 2 hours. I pulled up at 9.20am and left at 9.45am, I then returned at 11.55am to the same bay. On returning to my car at 12.30pm I discovered a PCN which says I had parked longer than permitted and the times observed were from 9:30am to 12.01pm - which yes my car was there at both those times but I had considered them two separate stays, have I got a leg to stand on?

Yes, you complied with the restrictions and therefore the contravention did not occur.
can you supply any proof you were elsewhere between 9.45 and 11.55, receipts maybe
Did you park in exactly the same spot both times?
Unfortunately I don't have any paper trail for my morning so I cannot prove that I made two separate stays, and it was in the same bay which in hindsight was a bit silly.0 -
CEO should have photos of your valve positions which should show they're different. The odds of BOTH wheels on the recorded side being the same are thousands to one.
If you can view your PCN online then login, look at the pics. If there are no pics, ring the parking department and ask for your valves when first seen and when the PCN was issued. Also ask if the CEO recorded the engine temperature at the time of issue as this is pretty important. Stone cold and there is not much chance you've moved. Still warm after 2 or so hours and its obvious that the car has moved and come back.
How do I know this? - I used to be a CEO. The CEO was probably in two minds themselves. Most would issue a PCN for returning (Code 22 if memory serves) but its common to issue a code 30 for overstaying instead.
You DO have a leg to stand on so get in touch with the council and ask the questions above. If the CEO doesn't have pics and hasn't recorded the info above then its a very weak PCN.0 -

Many thanks for your advice. I have checked with their online system and they only have 3 photos - one of the car head on, one of the car taken from a distance at a diagonal angle to show its in the bay and a third of the roadside signage with the restrictions shown. There's none with a closeup of my wheels.0 -
It's a phoney ticket then. CEO has pulled a fast one to keep their numbers up. Shady little ****. I've seen plenty of cars like yours reparked and had to stand there scratching my head, its easier just to walk on and not worry about it.0
