Stamp Duty office inefficiency - help please

Arrrgh I'm getting really annoyed with the stamp duty office.

Bought my flat in late November, my solicitor filed the SDLT return within the requisite time. (My flat is shared ownership but as its FULL VALUE is under £150k in a disadvantaged area, is not liable for SDLT).
Just before Christmas I got a SDLT demand for £580, this being what I would have owed if I had been paying SDLT on the premium rather than the full market value (due to the complexities of shared-ownership SDLT, with which, believe me, I am now extremely familiar).
Contacted my solicitor who said she had contacted the SDLT office and dealt with it, on 18th December.
Last week (5th Feb) I received another demand, for £580+interest and the threat of "recovery action" if not paid by 14th Feb.
Phoned SDLT helpline on 6th Feb, was told that it was definitely an error, caused by a mistake on the original return by my solicitor (this is consistent with an error that my solicitor initially also made on my bill!). I was advised that in order to rectify this I should fax the Birmingham stamp office with details of the necessary correction. I did this the same day, 6th Feb. I then contacted my solicitor who, later that day, said he had spoken to the Birmingham stamp office and had my form amended accordingly.
Today I thought I'd better check up on things, as the 14th Feb deadline has now passed, so phoned the SDLT helpline again.
Was told that they had no record of any correspondence on my transaction since the initial phone call from my solicitor on 18th December, and that my form is still wrong and showing that I'm in debt to them :wall: :wall:
The latest is that I was told to re-send the fax I sent on 6th Feb, marked for the attention of the advisor I spoke to this morning, and that he would pass it to the Finance office to get the recalculation actioned.

This is causing me a lot of stress as we're now beyond the deadline when they said they would "commence action to recover the debt" and they STILL think I owe them money!

The advisor I spoke to today has said he will phone me back late this afternoon to confirm that he has passed my fax on to Finance, but is there anything else I can do

  • Your solicitor is probably as frustrated as you are and she is not alone!

As a conveyancing solicitor I believe the information given in the post to be useful but I accept no liability except to fee-paying clients.

As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.
