Car dealership asking for Money for docs

I have been attempting to reclaim some mis sold PPI from a car dealership that we purchased a car from in 2005.
They have rejected the claim and rejected the dispute that I followed up with. They have enclosed a letter with the rejection stating that if I want the documents relating to the PPI, I will have to pay a non refundable £45 for them to look and they don't know if they will actually find them ! This is because it is over 6 years ago (just).
We wrote to the Black Horse Finance, who the loan was with, and they have sent me a copy of the signed agreement but told me that my claim should be with the dealership and not them as it was them that sold me the policy.
Is this all I need to proceed to the Ombudsman as I really don't want to give them the £45 as I suspect they might just be trying to get the money from me, their letter was very abrupt back to me and basically accused me of trying to con them !

Can they charge me this money and do I need any further docs to take this to the ombudsman ?
I don't want to give them the satisfaction of giving them an extra £45 after the 2 years of paying for PPI that I told them at the time I did not want and now find out I didn't HAVE to take out to get the loan...0 -
You have all you need to take this to FOS.
Send copies of all the letters that they sent to you and that you sent to them regarding this.

The reasons for mis sell I think are multiple.
Firstly the loan was to buy a Taxi as I had recently lost my job and been made bankrupt (was not discharged yet) so this was a way of getting back to work etc.
Therefore the car was purchased in my wifes name, she was working for the council and would have full sick benefits etc.
We explained that it was myself that would be paying the back the loan and that it would be me that needed to be covered. They explained that for me to be covered I would have to be on the loan agreement but I couldn't be cos I was still bankrupt.
We therefore said we didn't want the PPI as it was so much more expensive but were told that in our current financial situation there would be no way to get the loan accepted unless one of us took the PPI policy.
We had no choice but to agree as it was to purchase a taxi that would give us a wage.
The reason the garage rejected us is that they say all their advisors are fully trained and would never have said this. They say they have a signature on the agreement and that it says optional on it.
The annoying this is that it was the owner of the garage that served us !0 -

The agreement does not say what was told to you to make you take this ppi,also your wife was covered for sick pay for 12 months,the sickness on the ppi would only have covered her for 12 months anyway,and i assume she has life insurance?this would negate two of the things the ppi would have covered her for.
Pass this to FOS and put what i said above as reasons for mis sell,you will have a wait i am afraid,the FOS are taking about a year at the moment!.
When FOS get the complaint,they will contact the garage,maybe the garage will bend,you never know.
I would take this to FOS,ring the garag0
