Refusal to provide copy of loan agreement

I took out a substantial loan with Argos in December 2006 and repaid it in April 2008. I'm not 100% sure but I'd be willing to bet that I had PPI and that it was probably mis-sold.
I no longer have any paperwork, so I requested a copy of the agreement, terms and conditions. They refuse to provide it, saying that s. 78 of the Consumer Credit Act 1974 doesn't apply because the loan was repaid in April 2008.
What do I do now?

  • The old 10 quid cheque and request a SAR, which bank rolls Argos?
  • Thanks.
I'm really new to this so please forgive me - what is SAR?
    The letter is from Homebase.

you need to find out which bank is the underwriter for the argos group.
  • Hi guys,

I'm about to embark on a quest to reclaim - my problem is I no longer have several of the account numbers of old credit cards etc - how do I go about this process without this information?

    Many thanks in anticipation.

You sent the wrong request in. The method you quoted only applies to debts in force/outstanding.

You need to do a subject access request costing £10 if you want to see if they still hold old details. However, you do not actually need any past details to make a complaint. You can do so just by stating what your reasons for complaint are.

  • Thanks all. I think that's clarified things for me.
