PPI help please

Hi can anyone help me, my husband purchased a car from Available Car and we were asked if we wanted PPI Insurance we said no we would sort our own out, so he ticked in his paperwork that it was not needed (we have a copy). about a month later 19.00 started going out of the bank, so he rang up and we found out it was PPI. by this time my husband started to have trouble with his knee's so we decided to keep it incase he had to have time off. well 3 1/2 years later my husband went into hospital for a op for his knee with up to 6 months off work. so we decided to claim and after 3 months they have go back to us saying they will not payout on the claim because they say that he started with the problem before we took out the PPI (even though we did not want it). Have we got a case of mis-sold due to the fact we said we didn't want it or the fact they say he had the problem with his knee before we took PPI out.

The fact you have some documentary proof that you refused the PPI and they then still put it on should be grounds to start the claim. I wouldn't go into the other stuff at this stage, just fill the questionaire in with the fact you declined the policy and it was added anyway, if you need to later you could bring up the fact that when you realised you had the policy and needed to claim you were excluded anyway.
TBH the vast majority of PPI policies were on mass, systematically miss sold purely for the sales people and banks to rake in the commision.
Depending on who the lender was will dictate how long a battle you have lol. Some just roll over and pay up, some dig their heels in and hope you give up.
