    Thanks, does 50/50 mean each pays for their own or I have to pay 50% of the damage to hers?

    She is young and dosent want to put it through insurance she said. But I have a feeling it all might change when her father calls!

    50/50 each pays their own. Which as i said will depend on the car she is driving.

    Dad is the funny one here. If she wasn't moving or told him she wasn't then expect an argument.

    I'm still not sure how she could be pulling into a space it sounds like you were still blocking though!

    50/50 isn't each pays their own!

    It is each pays the other side 50% of their costs.

    ("Each pays their own" used to apply when both sides were equally to blame (known as "knock for knock"), but no longer used.)

    It sounds like 50/50 to me too, but at the end of the day the indpendent witness is in a much better situation to judge.

    Witnesses are just that (ie witnesses, not a "judge").

    Insurers will want to know what the witnes saw, not their opinion on who was to blame!

  • If he starts getting arsey with you, tell him you'll get your dad to ring him, haha. No point arguing with him when he wasn't there, it's not fair her getting her dad to ring you.

    Your premium before the ncd will still increase though, so you will end up paying more.
