i recieved a clamp and trying to appeal for this someone help me pleaseee

hiya,
on 9/11/11 i got clamped outside my fathers block in kingston upon thames, i had just found my father in his property who had sadly passed away and was not in the right state of mind to think to put my car anywhere else, i do usually have a vistors permit which had expired in april 2011,
i tryed to appeal for it due to the circumstances, and they have been messing about ever since first i call them they say they have recieved it and will be getting back to us, i call them 2 weeks later they say they have not recieved anything so to write again which i do, i then speak to them again and they tell me they need a envelope with a stamp on it sent to them so they can send us a letter, i then do this and they send me a letter saying it has been rejected, there was no apologies for the circumstances nothing, just stateing they have rejected and as far as they are concerned the matter is now closed,
i really need someones help as i am only 22 and have never been in this situation,

please help:(

    Very sorry to hear about your father, obviously dealing with that is going to take all your attention. So to sort this out you need to find out who the landowner is, the agent and the clamping company, and send a letter before action to all and take them to court, don't just do the clampers as they collect ccjs for fun.

    Can you name and shame the clampers by the way, take photos of their signs, your parking space etc, and scan in the paperwork from the clampers and upload them to here . After that register at pepipoo and post the contents of this thread there in a brand new post, include the link from photobucket. They are the experts in this, and will help you.

    You have wasted a lot of time and should have asked earlier. You cannot 'appeal' a private clamping as they are scammers, you have wasted some time but it's not too late if you have resolve and still definitely want your money back.

    You have to sue the clamper jointly with whoever contracted them to be there (often the flats' managing agents, sometimes the landowner, sometimes a residents' association).

    Look how many clamping cases are on the first couple of pages alone, loads! Read a few then start your own thread for help. Post with pics of the receipt and letters, also did you get a pics of the signs there? You will only be successful in suing them if you have grounds to show the clamping was unlawful or unfair (such as not enough signs, not clear signs, or an incomplete receipt, etc). Not on the mitigating circumstances I am afraid, if push comes to shove and you have to proceed to Small Claims Court. You don't need a solicitor BTW.

    Get yourself over and registered on pepipoo if you want some help to establish some facts to use to sue. Often cases are settled out of Court by the way - but not by putting pressure on the clampers, they don't care. You need to put a lot of pressure on the other party (whoever contracted the clamper) as that's where the refund money will come from - and they won't like the idea of Court because they have assets to risk.

    Just wanted to add, I was so sorry to read of your situation - absolute scumbags to do this and keep the money when your father had died. Would they clamp a hearse?!

    How much did you have to pay? Even if there was a "contract" notice you can argue the contract is unfair. The landowner is definitely the one to sue, the clampers will be just cowboy fly-by-nights who it will prove very difficult to get money out of, the landowner won't like it at all.
  • hi again, thank you for your comments, i will be going there tomorrow and will take pictures of the signs, and i will hundred percent try my hardest to get this money back, it was only £80 but its the simple fact it should have not been done, also
    like i said earlier i have a permit that expired april, have spoken to a few of my friends who live around there and noone has had a new permit threw the door yet and none have been clamped but me :mad:!!

    i wish i never payed it but i couldnt deal with them at the time,
