    Well, if you want to avoid spending anything to get the solicitor involved in establishing whether the deal is a goer, it is not that important to you really, is it?

  • Your buyers should be satisfied if you could just tell the agents to put the property as STC or something. And put a hold on viewings for the moment. Why is the agent not suggesting this ?

    There's no comfortable way for either the vendor or buyer really.

    Asking for proof probably wouldn't achieve much. Things can still go wrong or people can just change their minds.

    Just leave the house on the market. That way, if it's another duffer you won't have lost sale time.
    It's fairly common for buyers to want houses taken off the market because they worry another (& sometimes better) offer may come along.
    From a vendor's point of view, unless you particularly want it to go to this buyer & are prepared to possibly lose a sale if they don't work out, then leaving the house on the market is the fairest way.

    Thank you all for your comments very much appreciated. The agent tells me the buyer knows we haven't seen anything to buy and it may take a while and the agent told me that the mortgage is in place.My problem is not the buyer or the offer or the fees but the agent. So do we want to sell? Answer: yes. Do we want to deal with an agent that we cannot trust? Answer: no. Just so I know. If the offer is withdrawn at a later date where so I stand with the agent with regards to leaving? The contract with the agent finally ends next week.This is why they have been so pro active this week.

    If your notice is in, it is over. But in your position, I would write to them and instruct them that if this sale falls through, notice stands and give them 14 days to provide a complete list of potential buyers for whom they would claim and introduction on your property. If you a response listing introductions, then keep it safe.

  • I don't mind taking the house off the market but wonder if this is the agents idea because I told them that I will be putting the house on with another agent.
    The condition of the offer to not allow any further viewings and to remove it from the market was very specific.

    Do read your sale agreement very well. Did you make a sole agent agreement? If so, check this: until expiration date, do the EAs have rights to charge you fees if you sell your home no matter how you sell it? How long do their fee rights extend? Ask for a list of viewers that have been through your door by this EAs.. Try and find if you have to pay them for cancellation costs, some EAs do, but some not. Try and contact the property Ombudsman and ask advice on your problem.

  • Thank you. I did read the contract before I gave notice. However I think that maybe I should discuss their actions with the Ombundsman.
    I want rid of them but want to sell and still don't know if I should accept the offer placed and risk them keeping us holding on as has already happened once or just leave them next week as planned and start again.

    You may have to pay the EAs their fee if you finally complete the sale with the buyer they have introduced, no matter if you gave them notice.
