Please please help

We've had the bailiff around for council tax debts, other half let him in signed the walk in possession thing.
The bailiff has given us 24 hrs to come up with £1077 or they will take much of our stuff..

We have 2 children under 4. This is not their first visit but we have failed to reach an agreement.

Needless to say we can't come up with that cash without resorting to a loan shark.

CAB can't see either one of us until tomorrow afternoon at the earliest, it is our intention to seek a DRO, can we seek one DRO each or is it one per couple?

Is there anything we can do to prevent them taking the stuff in the mean time, and would a DRO work (during the DRO period?)

Please help, I'm all garbled I am suffering with PND and am due to see the doctor again tomorrow.. I don't know if that has any baring on advice? X

    Sorry, not my area of expertise either. Just to say that in your situation i'd let them have the telly and/or other stuff if that settles the debt rather than going to a loan shark. That's a road of no return as far as I'm concerned.

    I can assure the bailiff cant return in 24 hours to remove your goods (do you have this threat in writing )


    can you please list the goods the bailiff has levied
    can you you please tell us what fees have been charged by the bailiff as he has written it on the notice of seizure including the amount of the liability order

    please name the bailiff firm

    are you or your husband employed

    is the bailiff certificated to the bailiff company he is employed by

    Can you ring one of the debt charities for advice? They might be very helpful in the short term until you can get to the CAB?
    Our LBM: Dec 2011. DMP started: Jan 2012. Debt at LBM: £41,568

    All we have in the house is a bailiff removal letter from rossendales ltd mr Hill bailiff in charge.
    In full inclusive of costs = 2082.70... C.tax came to 1852 approx. the rest is, I presume the charges for other half letting them in twice.
    H2b is employed, I am sahm currently, due, in part to MH issues. In receipt of CTC WTC CHB HOusing benefit and council tax benefit (£60 approx PCM) total incomings When all counted £22000 approx including all 'help' x
    Eta the letter states 24 hrs to pay, yes.
  • Contact the council and ask them to put the bailiff action on hold until after your CAB appointment.
    Sorry to say but that even a DRO will not withdraw the rights of the bailiff to remove goods for non payment, so if you want to protect your goods you will need to come to an arrangement to pay and stick to it even post DRO to prevent them selling your stuff.
    Take the walking possession agreement to your appointment and they will check and ensure it is vaild.

    Are you on benefits or anything? If you are vulnerable you may be able to get it put back in the hands of the council.

    Ideally you should've gone to the CAB when you first started falling into arrears and before the bailiff action, as it's now more difficult to deal with with greater implications, but what's done is done and a lesson learned. Contact the council ASAP for a temporary hold until you've seen CAB tomorrow..

    when your hubby let the bailiff into the house and signed the walking possession agreement there should also be a notice of distress listing the goods the bailiff has levied (do you have this what goods are listed on it ) the list of goods levied is very important as there are certain goods the bailiff cant remove the goods levied should also cover all bailiff fees removal fees storage fees auction fees and a portion of the council tax debt
    also on this notice of distress there should also be a list of fees charged as in

    previous visit fees
    levy fee
    walking possession fee
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

  • The guy didn't leave that, he just left the letter they would ordinarily have left if we hadn't been in, he only did that, apparently, because I was also in with the littlest one and I put up an argument.
    But hubby did sign the walking possession. The bailiff left though.

    The tv, two consoles (one of which isn't here as it is broken.) two sofas a dishwasher and a tumble drier (which don't belong to us.. And we can prove that) a broken laptop 3 broken Pc's and I *think* today he added assorted DVDs games and other bits..

    Are there any ways of accessing funds to pay this guy without resorting to a shark? Xx

    you do not have to resort to a loan shark you need to make a payment agreement with the bailiff/council to pay x amount per month put in writing (e-mail) to rossendales and the councils revenues department

    Its a rare occasion that a bailiff actually removes goods subject to a levy they would rather have payments

    on the surface this levy looks good however the only thing thats actual worth any value is the TV (if it new style flat screen) even that may have little or no value and 1 working console

    did you make the bailiff aware at the time of the levy that some of the goods don't belong to you and that the lap top and 3 PCs were broken (who do the goods belong to are they on HP)
    is the TV top of the range


    have i got this right you have had a bailiff in your home twice

    previous to todays visit the bailiff levied against these goods

  • Afaik he added them to a new one,
    The goods are on HP in my mothers name and address
    As far as I can estimate the tv is worth perhaps £150 it is 3 years old and was £400 ish new.
    The console again worth at most £75
    The games and DVDs he added anew today, dispite being an extensive collection as a whole is worth around £75 as separate items. Blurays around £15
    The sofas are 3rd hand.. I doubt their worth at all.
    How would I go about submitting an offer to rossendales or to the council? What would I say?
