Hi,
have questions
I am (non-eu staying with residence card) married with EU over3years, and decided to buy our first home. We have got offer,house is choose we loved it!
BUT Mortgage and House Deed not going to be join name because of my visas expire. But bank and solicitor need my sign also as living same property.
Our solicitor said they are just helping exchange the contract not family laws!!
Now if my love change mind and try to divorce me, Do I am the half owner of this house?
What is my right??

Sort out your residence permit by visiting the UKBA site and downloading the application forms. You have no claim to the property if you are not on the deeds. You are being treated as a tenant. If you proceed with the purchase now in the hope of correcting the situation later the least it will cost you is money. If you let things continue you may be required to leave the UK and the strength of your relationship will certainly be put to the test. Depending on the nature of the visa that is expiring you may be better off applying for residence on the grounds of long term residence rather than on the grounds of marriage as you would keep the former if your marriage breaks downLife is like a box of chocolates - drop it and the soft centres splash everywhere0

I have a visa, but I must wait till my visa finishing to apply theother one. We have little one and just thinks they said they can not put me on deeds cos we buying from housing Association.

I think you will find that you are not entitled to anything. Go and speak to a solicitor and find out your rights.

As the spouse of an EU national you should qualify for a residence permit now provided your spouse is based in the UK. This residence permit gives you the full protection of all EU employment, property and associated laws. You won't be taken into consideration for the mortgage as a non resident only your husband will so if he's obtaining the mortgage on his wages, the house is his.
