Sold Subject to Contract (or not?)

Just looking for opinions...

We've just accepted an offer on our house and have spotted a house we're interested in.

The house in question is listed on Rightmove with 2 separate agents, Taylors and Haart, both have it showing as available, however when we contacted Taylors we were told it was sold subject to contract, and in fact it is shown as sstc on Taylor's own website (but not Rightmove).

But when we spoke to Haart we were told that there was an offer on the property but it wasn't sold.

One of them is messing around, but not sure which...

  • An offer on a property is subject to contract, and a property isnt sold until contracts have been exchanged, Phone both of these agents demand to know whats going on, sounds a bit like somebody is after the commision. Or ask to speak to the sellers directly, ( that will make them move!)

    One of them has an acceptable offer on the table and is waiting on the legals going through, if everything goes well then the contracts will be exchanged and the deal done.
    Nothing is set in stone at this point and the sale could fall through, they keep their options open just in case.
    If you really like the house this is where gazumping comes into play, it doesn't happen much these days because of the current climate, but a few years ago gazumping was common, a bit unethical but it's hard for a vendor to turn down an extra few grand.

    Your next logical step would be to ask the question;-

    "Is it still possible to view the property?"

    and use the answer to determine your next course of action.

    We've viewed the property sound structurally, but very dated throughout.

    For got the last odd bit in that it is SSTC with Taylor's, but only went 'live' with Haart on Rightmove on 3rd Feb?

    Maybe the property has been on before that, and their is a buyer for it, but they have remarketed it for one reason or another.

    If you have viewed it, then make an offer, and see what they say.

    If it all seems messy, walk away, and look at other things.

    My house was on Rightmove with 2 agents last year and it was only ever listed SSTC with agent who had the offer. I suspect the other was always hoping that they could secure a better offer.
    My understanding is that they will put under offer on when an offer is accepted and change to STTC when things get a little more formal with surveys etc.
    Always remember that nothing is certain till exchange of contracts.

    Neither of them are messing around; there is no conflict in their stories. I would suggest that Taylors have received an offer on the property but it has not yet reached the contract stage. They have updated their own website but no RM on the theory that a potential gazumper using RM might choose Haart rather than them if they put SSTC.

    Haart are aware that it is under offer via Taylors but they are hoping that they can still sell it, either because that offer falls through or because the vendor will entertain gazumping.

    Ok. So your next step is an offer. It's obviously early days if the vendor was only just going for joint agency, so no-one is likely to have spent any money if that's what's concerning you.
