fsa time scale

hi , i have just filled in a pile of questionares for the fsa in regards to a rejected claim from m&s money .

the reason i am appealing is that i have had 3 other sucsesful refunds and feel i have been unfairly rejected ( 3 companies refunded yet m&s rejected an identical claim ??!!)

my question is how long is the time scale in regards to appeals to the fsa ? is it 12 weeks as if you were complaining directly to the company ?

any advice would be appriciated !

    Sadly it's not 12 weeks, it's probably over a year, the queue is massive. You'll hear from the FOS after a few weeks acknowledging the receipt of your forms and they'll say when they expect to contact you again, which will probably be about three months later and that will just be to apologise for the delay. The upside of this is, depending on your claim and the outcome, the 8% stat interest (if applicable) will continue to accrue on your refund while you're waiting. If an FOS adjudicator does reject your claim they will explain on what basis and you can decide if you want it looked at again by and Ombudsman.

    How would it be identical? Different forms, different people you spoke to etc.

    Just because others paid out doesnt mean they all will. Maybe the others were being auto upheld as they were below their floor limit. Maybe you didnt have a case on any and just got lucky with the others.

    What are your complaint reasons. The FOS will ask you. So, you need to be clear on it. They wont work on the basis of other complaints.
