Notice pay when made redundant on Maternity Leave ?

If I was on maternity leave until 22nd Jan 2012 and accepted redundancy on 10th jan 2012 should my entitled one months paid notice begin on the 10th jan to include my remaining maternity leave ending on the 22nd Jan and up until 10th Feb at normal rate of pay ... Or should I receive remaining maternity pay until 22nd jan and then a further 1 months notice pay at normal rate?

I have been with the company for 4 full years (would be 5 on 14th feb 2012) working 24 hours a week on minimum wage. I was phone at the beginning of Jan to inform me there was no longer a position available unless willing to change my role, which I wasnt. I have received redundancy pay for 3 weeks (they have short changed me by half a week) and have also received my notice pay but a chunk of this is made up by remaining maternity pay rather than a full one month on normal rate of pay and just wanted to check this is correct.

    What is confusing me is why you have accepted a phone call telling you your job is no longer available, just like that. You are aware that (a) you have the right to consultation and (b) you have the right to return to your post unless it genuinely is redundant - and based on what you have said here I do not see any reason to believe it is and (c) you have the right to return to a suitable alternative position.

    Have you not got a pay slip at all so you can check it. Some companies pay redundancy pay on your age aswell. EG if you are under a certain age then you might only get half a week pay for that year and the rest 3 x full weeks pay.

    Your notice pay should be at full pay even if on maternity or sick.

    I would address the redundancy first to establish if you really are redundant and when the notice starts.

    I'll explain my situation to you and see if it helps.

    My maternity pay runs out on March 23rd, then I am on SMP till August 21st.

    We are being made redundant (unless we have applied for the new positions that have been made and been successful) on March 16th. Therefore my full pay will cease on March 16th and I will receive 5 weeks notice pay. I should then receive maternity allowance (instead of SMP, but the same amount) until August 21st.

    As SarEl says, what is happening to you in terms of the phone call, and the (lack of) options offered doesn't seem right. I'd speak to ACAS or your union if you are a member.

    Luckily for me, my employees are fair but some do try it on!
