Redundancy and TUPE Question

Hi

I am looking for some advice regarding redundancy and TUPE. My current public sector employer is making me redundant but there is a chance that a private group may be able to fund a similar if not same role on a self employed basis.

The roles arnt officially being TUPE'd as employer not looking to outsource the post so I am just wondering if this situation does fall under TUPE. If it does could you also shed some light on how long I would have to leave between taking my redundancy and starting in a self employed role with the new company so that my redundancy payment isnt affected.

Any help you can provide would be appreciated

    TUPE does not apply to self-employment.
  • So based on this, am i correct in saying that even if the role was exactly the same but I was to become self employed (paid via private funds) to do it as opposed to being employed by current employer it wouldn't be affected by TUPE and therefore my redundancy package should remain intact?
