Attempting to reject used car

  • I've been speaking to Consumer Direct who say I can reject and am entitled to a refund. I've had to send CarWorld a letter though formally rejecting the car and I know this will not be a 3 day turnaround (already on about 14 days).

    Good to here that you had success with a private seller. Didn't think it was as easy as a trade seller.

    A thought for you. A long, long time ago, I bought a 2cv vehicle for £1300 (a lot in those days), it went through its MOT 9 months later and its chassis was knackered (it, is, apparently, a well known defect and would cost £900 to replace). I even contaced the ex-owner, who admitted he had welded the chassis because it was a mess. The "garage" I bought it from blamed me, so we went to the small clams court. Obviously, you cannot do that, but only reason that I won, was because I had a 'Mechanical Enigineer' in tow. You may find in these days of cut-backs and ambulance chasers, that some lawyer will take it on as a no-win-no-fee, or find a Mechanical Engineer to help your case. The very best of luck!
  • Thanks for the reply. I kind of do have an engineer in this with the AA Report on the vehicle. I know I should assume anything but I'm sure a fully comp report from a qualified engineer from a company with over 100 years expierence should do the trick.

    Anyway, had a letter back this morning stating that they would like to have the vehicle back tomorrow so that they can investigate and come to an agreement.

    I'm going to speak to Consumer Direct first as the agreement in my eyes is a full refund. Also, I want them to collect the car as I have been told it is unroadworthy.

    Again, will update with any progress.

    Carworld took the car back for inspection on Wednesday and late on Friday I had a response from them. They have now agreed that the car is in a poor way and they are sending a cheque for the full amount of £5990 as they no longer have my old car.

    I'm still around £350 out of pocket with things like cost of AA inspection, changing insurance, car had half tank of fuel left, been using the train to get to work etc. This is expensive motoring seeing that I only had the car for a week (the rest of the time I couldn't drive it) and had only covered a few miles.

    All I can take away from this is to get someone like the AA or RAC to do a check on the car before you buy it. It might be nearly £200 but for the hastle it will save you later, it is more than worth it.

    Still might see if I can do something with small claims for the money I am now out of pocket but need to think and maybe speak to consumer direct.

    At least you have the bulk of the money back.
    What do the garage say about the out of pocket expenses before you take them to small claims?
  • So far over the phone they have said no. I'm going to wait until I have received the cheque and it has cleared before contacting again about the out of pocket monies. I just don't want them to cancel the cheque for any reason as I really need to get a car.

    I'll post a letter to them once this is done stating the amounts etc and see what comes from that. If I get no joy I'll then look at small claims but want it to be a last resort really.

    I don't see that they owe you for the AA report, that was an expense that you voluntarily entered into before giving them a chance to inspect the vehicle and tell you what they were prepared to do for you.

    Yes, it helped you fight your corner, but I don't see that this means they owe you for it.

    They do owe you for the extra costs that you had to pay to get home. And for any public transport costs whilst unable to use the car as long as you have kept all the receipts.

    But I think you'll probably find it more hassle than it's worth to fight them for those costs.
