Mat B1 form

Hi. Quick question. I have just had meeting with accountant as part of quarterly review of partners business from which i am paid a basic salary monthly for the admin whilst he is away (he works away for four weeks then back for 4 weeks). SMP was mentioned by the accountant as we have an 8 week old baby and it appears that we can claim SMP upto 40 weeks after the birth of our DS however i never recieved a MAT B1 form from my midwife. Does anyone know if i can get one now and if so how and who from. Many thanks

    I think my form came from the midwives l saw at ante natal clinic, worth ringing your health surgery and asking??

    Don't you plan on doing any of this admin work over the next 40 weeks then? If you were meeting with the accountant, that suggests you are still working in the business and haven't taken maternity leave.

    SMP is only payable when the employee is off work on maternity leave, and you can only work on a maximum of 8 days during that period before the entitlement to it ends. It isn't a way of a family firm boosting its income and claiming a subsidy on a spouse's earnings from the tax payer because a baby has arrived, when the spouse is still working in the business and they are benefitting from her services.

    I'm not sure if a MAT B1 can be backdated and you'll need to check this with the tax office, not your midwife as she probably hasn't come across this situation before.

    You can have a Matb1 form from your midwife or Gp up to three months after your baby is born, however midwives only give them if asked, it is not routine. so if you didnt ask, she wouldnt offer.

    I don't think a MATB1 form can be back dated as it has to be submitted to your employer by the 15th week before the due date of your baby.

    As others have said, if you are continuing to do any work then you cannot claim SMP, the only work you can do whilst claiming SMP is a maximum of 10 'keep in touch' days.

    Your health visitor may be able to help with your baby already being here. I got mine from the midwife when I was about 22 weeks. My GP refused to give me one as said he couldn't verify I was pregnant!! (No Dr, I always walk about with a cushion up my top!!)

    Part B of the form says to fill in if you are giving this certificate after the confinement, so it is possible to back date.

    I thought that was only for if the bay was delivered early but I could well be wrong!
