Getting it wrong

Well felt like parking there for 3 hours to see what would happen lol

    So non-customers are not allowed to park there but sadly don't get the excitement of one of their 'PCNs' (a penalty about as legit as a Palace penalty aginst the Seagulls of course...).

    Did you get a 'penalty' awarded to you taffy? :D

    Nope ;) though could have used it against Chelsea on Tuesday :(

    And have just emailed the head office about illegal parking signs in their car park, back down there today to see if they take my complaint to the local authority seriously lol

    The sign is not illegal, the act of issuing the notice in the name of the local authority would cause the breach ,I still do not understand your interest.
    This could only be a problem for anyone wanting to overstay in our car park.
    Our car park is private property . we can charge people to park if we wish .when people park outside our terms they are in effect in breach of contract and technically we could issue proceedings .
    As our sole aim is to allow our customers to park next to the store and to my knowledge we have not issued any notices I am at a loss to understand why this is a problem for you.
    The sign carries our logo and in no way tries to represent itself as the local authority.

  • Have you tried presenting it in really simple terms, i.e. just say that the use of words such as penatly and fine cannot be used as terms in a contract by a private party (them), and would seriously prejudice any procedings they may take in the future.

    Have tried that, will try once more in more simplistic language , been trying to get what ppc they are using, probably somebody like flash park where you can self ticket ??

    What I can't understand, Taffy, is why you'd want to put them on notice that any "tickets" that get issued would be automatically invalid? LOL

    I think people are barking up the wrong tree here.

    The sign is not illegal just as a "trespassers will be prosecuted" sign is not illegal.

    Misleading possibly , but illegal, I rather think not.


    The actual point is that such penalties are not legally enforceable.

    The business is correct they could issue proceedings but they will lose every time by their use of the term penalty.
    I agree why flag this up for them ?..let them carry on deluding themselves if they wish.

    Yes not strictly illegal, but the council down here takes a very dim view of claims of authority by saying a penalty is issued. Still it's all part of the fun, was trying to discover who the ppc behind it is, there must be one ;)

    Stupid council then, have they not got anything better to do ?

    Private sign, on private land no actual claim of authority ..none of the council's business !

    It is entirely possible for a landowner to "police" their own car park ...they may just have put a sign up as a bluff , no more ..so there may not be any PPC involvement at all !
