Problems with Endsleigh car insurance

First time post so be gentle with me.
Endsliegh have my card details as I paid the deposit for a 3rd party when they took out insurance. I also used my email address and telephone number as contact as i was a named driver and the 3rd party was going to be travelling to and from abroad alot so was not going to be contactable as easy as i was. I spoke to endsleigh on numerous occasions from resolving issues with no claims etc etc and they were quiet happy to discuss everything about the policy with me.
Wasnt aware of any problems until I recieved an email from endsleigh 2 days ago saying because the policy was cancelled they have debited my card with £238. I rang them immediately and advised that they have basically emptied my bank and if the insurance was cancelled would be more than happy to arrange payment of any fees with the 3rd party however they insisted that they are well within their rights to debit the card as it states on their terms and conditions.
I explained that they had my telephone number and email address if they wanted to arrange anything prior to them just debiting the card when they pleased.
So after speaking to an advisor then a manager in regards to the policy and the fees etc. I decided to email their complaints team.
That was 3 days ago and i have recieved 2 emails from them stating because i am not the policy holder then they cant discuss it with me. I have replied asking why they have been happy to deal with me on numerous occasions previously not only their advisors but their managers too and surely I can discuss the fact they have debited my card that was only authorised for the use of a deposit (the monthly payments were set up by Direct debit).
I dont seem to be getting further forward with them and today found out after checking the bank that not only have they took the initial £238 payment they also have another £238 pending so this is probably a duplicate but the bank wont do anything about it until Endsleigh either accept or reject this. This has left me with nothing in my account as after they took the initial payment placed more funds in to see me through yet now that is sat pending somewhere leaving me with no bills paid or money for food to live.
Could anyone advise if there is anything i can do about this?

Sadly when you paid by card you probably authorised them to take any missed payments from it also.
Ask the person you lent the money to for it back?
Been a few of these types of posts, I guess written complaints and contacting the bank for a chargeback?Censorship Reigns Supreme in Troll City...0 -

Endsleigh have no contract with the op, and no authority to take any further payment.
Tell your bank to do a chargeback.
Endsleigh cannot pursue you, as you have signed nothing, and agreed to nothing, and are receiving no service from them.
They can pursue your friend, and eventually sell the debt to debt collectors, but again they cannot pursue you.0 -
Thanks for the advice. I have since spoke to the bank and they said they can't do a chargeback cause somewhere along the line I've give the company my card details. I explained that this was for the deposit only. It seems like by what they saying that if you give your card details to any company they can just help themselves to money (even if incorrect) and not much I can do through the bank. The same with the pending transaction that has duplicated. I have to wait until 7th February to see if they accept it. If the company don't accept it then I'll get the money back however if they accept it the bank will charge back as a duplicate. This is unbelievable in the meantime I have been left with 30 in bank to live off until its resolved.0

Basically if you offer your bank card up for someone else's payment, you agree to pay the lot if the other person can not be bothered.
This is a reoccurring problem on these boards.
Never give your bank card details to pay someone else's bill, no matter how well you think you know them, the banks know them better.

However like someone posted on here, there was no notification no prior warning no phone calls emails no nothing to try to resolve this. They just took the money off my card. This isn't my debt the car insurance knew it wasn't the policy holders card and if they have to resort to underhand tactics to get money then maybe they need to specify they can only take deposits from the policy holder. I haven't signed anything in regards to payments jus the deposit. I have raised a complaint anyway and find it strange how their advisors and managers were quiet happy to deal with me about the policy holder and now I'm kicking up a fuss won't deal with me. Maybe trying to recover my losses through a small claims might get a reaction from them!0
