Cash advance for credit transaction

Rather asking for trouble with that approach. You did act in a way that implied you had read the T&Cs.T&C is just detail, these things need to be clear to all involved
This is what it says before you apply:You have read your Pre Contract Information, Terms and Conditions and Summary Box for information.
This is what the T&Cs, that you told them you had read, say:'cash withdrawal' means a withdrawal of cash made by you or any cardholder and also means any transaction made where you or any cardholder: (i) obtain foreign currency, travellers' cheques and/or money orders; (ii) make an electronic money transfer (excluding balance transfers); (iii) make a payment to open a deposit account; or (iv) carry out a transaction where payment is made to an establishment that is identifiable as carrying on gambling and the purpose of the transaction is payment for gambling

Out of interest, who?
The Halifax Clarity and Santander Zero cards will not charge a fee0 -
carry out a transaction where payment is made to an establishment that is identifiable as carrying on gambling and the purpose of the transaction is payment for gambling
And my m8 took us to a Casino in Leeds for a meal out one night , when he got the CC statement they had charged his retaurant bill as a cash advance and imposed a fee for it !
He rang them and they told him as it was in a casino they treated ALL transactions as cash advances
They agreed to refund the fee this one time but told him if it was used again even just for a meal etc he would be charged , fair enough i suppose but how many others are not aware of this ?A Bast**d I May Be ! I Was Born One !
Whats Your Excuse ?0 -
Thanks EycplUK,
That type of practice is precisely what I am refering to. It is not clear or obvious.
I accept that they have charged correctly as per their terms.
I do not accept that it was made clear at time of purchace as it is with most other cash withdrawals, such as at an ATM or a currency exchange.
Bogof, yes I do have the cash mate, though am new to gambling! The 'advice' always seems to be if you are buying something online or something you won't get in your hand instantly, use a CC. I've never seen an exception added to that rule saying 'unless it's on the lottery etc'
Still, lesson learnt and I won't use the website again. I would assume even if I visited the shop in person I should refrain from using the CC.
Do spending on the national lottery attract these charges? What about scratchcards?
Well hopefully my numbers will come in and i'll have nothing to complain about!0 -

If using the National Lottery site then yes it will be classed as cash and fee received.
If you buy the ticket or cards from a local store, then it will be classed as a purchase and no fee received. HOWEVER not all stores will accept credit card payments for lottery tickets.I do not accept that it was made clear at time of purchace as it is with most other cash withdrawals, such as at an ATM or a currency exchange.
What do you want? Every single place that accepts a credit card to say you may be charged a fee regardless? Prepaid cards generally have a fee associated to them when buying something tangible, e.g. say a computer but that retailer does not say "oh you might be charged a fee"And my m8 took us to a Casino in Leeds for a meal out one night , when he got the CC statement they had charged his retaurant bill as a cash advance and imposed a fee for it !
It is all down to how the merchant category code comes through on the transaction from the retailer. If this code (which determines the type of transaction is was) is classed as gambling you will be charged.
The easiest way to think of it is if you are using a card in a gambling establishment whether this is to play, buy food or drinks you COULD be charged.0 -
For sub £100 purchases it doesn't matter what card you use, and both credit and debit cards have a 'chargeback' procedure that can be invoked.Empty_pockets wrote: »The 'advice' always seems to be if you are buying something online or something you won't get in your hand instantly, use a CC.
For purchases (of goods or services) over £100, always use a credit card since that also gives you some clout in law...much better than chargeback and goodwill.0 -
Couple of messages to Capital 1 putting my argument across & £3 cash advance fee refunded!:j:j:j0

Generally for your first offense, issuers will refund these sort of fees as a gesture of goodwill. You just need to plead ignorance and sorry. I did it with MBNA when I got a fee as the transaction could have been deemed as either cash/purchase.0 -
Well worth knowing and always worth trying.
Never paid a penny interest or any fees on this card and intent to keep it that way.
Hopefully using it lots will be enough for them to want to keep me as a customer.0
