Barclaycard PPI rejected

i claimed againist Barclaycard for the miss sale off ppi. I honestly cannot remember ever discussing with an advise the benifits of PPI. I remember opening a barclays bank account with my wife and a few days later a barclay card arrived. I assume this was part of the account. I honestly believe this is the way the card arrived with me. In thier letter barclaycard have said then have found no evidence to support my claim and that at the time the card was given to me it was policy to explain that the PPI was optional and they can find no evidence to support that this wasnt the case. They have gone on to list that they find no evidence to support my claim. They have also stated this is the final letter and will not discuss the case further or enter into correspondance.

They have said to contact the ombudsman if i wish. However if i cannot prove it was miss sold and its my word against thiers is there any point in taking this further.

any advice would be welcomed

  • i really beleive it wasnt explained to me but it was so long ago, surely its unreasonable to expect someone to recall, and they should have something which i have signed to say it was explained to me

    Dont worry about looking for evidence to support your case. Maybe ask Barclaycard for proof that they explained the policy to you? if you cant prove them wrong. Tell them to prove themselves right.

    I would submit the claim through the FOS as they will look further into things for you.

    Lenders will often decline a claim if they think that the Client does not have the resources to pursue a claim further.

    with the FOS you will only have to fill in a questionaire explaining the situation etc when the agreement was taken out.

    You only need proof if you are making an allegation about what was said and its not something they would expect to have on file. For example, you dont need proof with single premium PPI as that is quite obvious what it is. Or if you have 6 months full pay, 6 months half. That is a factual statement (although they are within their rights to ask for evidence - that will likely come at some point as similar did with endowments where early complaints were not asked for proof but later ones were in areas that were being abused by the consumer).

    If your only complaint is a verbal allegation (he said/she said) then you will need proof if you are hoping to succeed. Complaints like that are very weak and rely on another failing to be successful or being with someone like Halifax who are auto upholding or being under a floor limit for auto paying out.
