I order a DS Lite form Savapoint on Dec 18th as christmas present (They took payment on dec 19th)- thnakfully I had a back up order with another company (dabs) which arrived, as the DS Lite didn't. In fact it STILL hasn't - 2 months later. The order still says "awaiting dispatch".
I have tried emailing and it took 2 weeks ot get even an automated reply. I've since tried calling their customer service numver but can never get an aswer.
What should I do now? I'm furious that i am being charged interest (paid by credit card) on an item I don't have.

Firstly, there's no law that companies should not take money until despatch although that is becoming accepted best practice. So there's no automatic right to a refund if the item doesn't arrive by what you consider a reasonable length of time.
Secondly, if you are having trouble getting hold of your supplier and it has gone beyond a reasonable length of time, you should phone your card company and ask them to put the transaction into dispute. Explain the reason why and they should seek to resolve the transaction with the supplier or do a chargeback if the supplier won't play ball. The chargeback means that effectively they forcibly reverse the original transaction and take the money back off the retailer.
If they've gone bust, then chargeback isn't going to work but the card company are jointly liable for the lack of supply of the item and they will (eventually) refund you - and any interest incurred if you haven't paid the transaction off in full.0 -

I'm wondering though what constitutes a terms of agreement when buying. the confirmation email I got when I ordered says "YOUR ORDER WILL BE SENT TO YOU WITHIN 14 DAYS", is that a contract? Does that mean as theya hve broken the terms I agreed to when ordering that I AM entitled to my money back?0 -
Yes you are entitled to your money back. Do as suggested and contact your credit card company.0
