Wow...38000 miles in 1 year...you needed to have said that to start with..and it will have a max of 2yr limited warranty left as Audi's come with 3yrs from date of first reg'.
It has clearly been hammered for 12mths (I used to do 40k pa so know what a hard life these cars have, but I had the benefit of changing cars 3-4 times pa)...so I don't doubt it has clutch issues if it's been driven hard around towns/cities.
With that level of mileage in 12mths since registration I don't think you've got too many problems to be honest, bearing mind the average domestic user would do less than that mileage in 3yrs...but you clearly need to follow up the paperwork issues.“Official Company Representative

Have you tried contacting the Trading Standards and/or Consumer Direct?
I am currently in "discussion" with the supplier of my new (to me) vehicle, 10 months old, and have had it for three weeks with various problems cropping up.
I contacted Consumer Direct and they were extremely helpful.

thanks guys,
it has 2 1/2 years of warranty left as i was given an extra year on top of the standard warranty as it was purchased from a main dealer.
