i was recently at an ATOS MEDICAL n now have the letter from them stating im fit for work and my ESA benifit will stop... my work doctor n own practice doctor say im unfit for work and i am signed off on sick line .. due to chronic pain after a hernia op... in atos eyes i can do office work... but unfortunatley my job isnt a clerical 1... i work in the care profession...why should the interviewers at atos get away with deciding your health problems ...when clearly your own doc has deemed you unfit to work n in my case my occupational health work doctor too!!!... clearly its the torie goverment putting pressure on these atos guys to deem you fit for work ... so they DONT HAVE TO PAY YOU DISABILTY MONEY... arrgh they make me sick!0

errrr no it isn't! This idea of getting rid of the so called ' sick' off benefits was dreamed up and put into operation in 2008 by the Labour government!!! The current lot just carried on with it because they agreed with what Labour had started.0 -

im not on here to argue the point of who did what....just whoever put this rule in place ... sucks!! hope it comes back to bite em in bum when sm day they mite be disabled n need help ...just think it shockin ... i got told to bring my medication n any important letters from doctors ,,, hospital etc to interveiw which i did ,... n the interveiw guy wasnt bothered about reading my notes from 3 diff health sources nor had he any interest in meds i was on... basically he was jus out to get me off benefits!!! grrrr!!0 -

I would suggest you look on this site to find out what others have done in similar circumstances to your own!
If you think the decision is wrong you can appeal.
No matter what you present at the assessment, you are there to be tested against agreed descriptors NOT that you are too ill to work!
It's just like a test you had a school - get the answers right and you will pass, get them wrong and you will fail.
You can be taught how to pass an exam and know very little about a subject yet you can know everything about the subject but just don't know how to pass the exam!
Quite honestly they are not interested if you only have one leg, one arm, one eye, one lung etc, you have to pass the test scoring the correct number of points along the way.0 -

i gathered that from the assessment sheet they send you back telling you how many points u scored.. in my case 6 points for my mobility as cant walk far without chronic pain... told them about my job i care for DISABLED people funnily enuff lol.. but with my own probs i can hardly be expected to support the ill n disabled .. wen i can hardly walk myself.... yes i will obviously appeal this decision... j
just how can they actually justify there decision on a individuals health probs as i sed they have deemed me fit to work in a office wer il be sittin alot n not walking ... but if they actually took time to discuss a persons job n wat it entails workwise they should realise im not fit just now for this type of work... just feel there assessment interview sheet is all wrong..!!... so basically there saying iv to pack in my current job of years to look for an office job,,, which according to them i can do... the mind boggles !! as there are a lack of jobs in this country ... i only end up on the dole costing them more money lol0 -
Hi Killiebabe the reason you are having probs getting 'disability money' could be that IF it is just the condition you describe (pain from hernia op) then I doubt it would fit in the long term category to qualify you. If however you are looking for support in the recovery period and worked up until this - then would have thought you should be enititled to incapacity benefit/income support etc in the mean time? I know my physical pain alone prevents me from doing an office job... As things have been changing so much with the benefits system the things Im on about (and still receive) might not even be available to new claimants but even if the name has changed the principals for qualifying shoudlnt be a million miles away. If you genuinely cant work because of pain then you should post back and ask for help with appeals procedures etc as there are much more knowledgable people than me on here. Or a better way of getting the attention of these might be to start a new thread (they normally respond pretty quickly). Regards Scott0

for your advice.
i was receiving employment and support allowance (ESA) i think this is the new name for incapacity benefit ... they pay you a basic rate for 13 weeks or until you go for ATOS MEDICAL if you pass the medical your entitled to a higher amount of ESA ... if you fail medical i think there still entitled to pay lower rate til you return to work ... will need to look further into this though...0 -

There doesn't have to be a job available even if one ever existed.
Are you now claiming JSA? which the DWP have presumably told you to do.0 -

No they aren't!
If you fail the assessment you would be expected to pop along to the jobcentre and claim JSA.
Unless you decided to appeal the ESA decision in which case you would continue to get the basic amount (same as JSA surprise surprise) until your case ends up at the Tribunal.
If you fail there - then you can start again and put in a new ESA claim provided that there is at least 6 months in between the original decision and the Tribunal hearing, or as some do, claim that your existing illness/condition has got worse - in which case the 6 month rule does not apply!!0 -
sorry i couldn`t reply last night as my house was burgled while i sat here at my computer

My hubby cannot do any manual work or any sitting down job as he finds it to difficult to sit for too long, the JC have put on his record "unfit for work", we told them his problems and he decided that hubby could not do any work, suppose we`ll just have to wait and see what happens.0
