signing on on partners due date

hi my son has had to sign back on for jsa after his contract came to an end. the date they have given him for his next sign on is the day his baby is due. he is stressing over this even though i have told him that its unlikely that the baby will arrive on cue.so my question is what would he have to do IF he misses signing on because his partner is giving birth?

  • As you say its highly unlikely that baby will arrive on its due date although not impossible.

    Why doesnt he just give them a call now, explaining the situation, and that if he cant make he will call them to let them know, at least that way its on file already that he is concerned and may need to re-arrange.

    Please tell him not to go in with that attitude even if it is what he thinks. I generally find that people respond in the way you expect them to. As long as he is polite and makes it clear that he's not trying to avoid signing on but he wants to give them heads up about a potential issue he'll be fine.
    The chances are the person he speaks to will have kids themselves or know those who do and be quite sympathetic.
  • When a claimant fails to sign, they are sent out a form which they must return within 7 days explaining why they failed to sign. It is only if this form is not returned (or it is returned but the explanation isn't satisfactory) that his money would be stopped. If he explains the situation, they will put a note on his record but he will still need to contact them once the time comes, if he is unable to sign due to attending the birth.

    They're really not that vindictive.

    If he fails to attend he must show good cause for doing so. 'Good cause' is not defined in law but is taken as a question of reasonableness - what would a reasonable person do in the given situation. If it is decided that the reasonable person would act as your son acted he will show good cause.
