flying freehold help

Hi all
I am a new. Please bear with me thank you

I have a multitude of problems all relating to freehold, and lease hold property. Been to the LVT found that most rewarding. But now have other very serious problems, regarding our new freeholder’s total lack of respect concerning the rules.

Latest problem is, our freeholder/developer has sold a part of our building to the tenants who occupy the office part. This has created the rest of the building (resident ional part) becoming a floating freehold.

We are also in progress of forcing the sale of our freehold back to us as; our right of first refusal have been breached. At no stage has the landlord complied with any rules or notices we have sent.

Now his 13 flats that are being erected in our yard has almost got its roof on. The tenants and occupiers of the ground floor (the office part) have just purchased their freehold and ground floor to our building, they are also, and sold some land they owed to our new developer/freehold, which was next door to our property (block). (But was land locked by a very old warehouse) that was attached to our building. This was knocked down to gain accesses and part of the new flats are being erected on the neighbouring land he has just purchased form the tenants in the offices. In our lease it also states the landlord must not do anything that would cause devaluation of the flats or block as it was called. We now find where once we had perfectly normal leasehold property’s. Now we got an iffy floating freehold. This will make it almost impossible to our flats. Not to mention if we force the title back to us, referring back to the invalid s5 offer we received. That started all this. We should have the right to transfer the freehold as it was and at the price paid back to us. But how can this happen if the new freeholder/developer has sliced it up, so that the office tenants and he profits at our expense. We are in a right situation. And any advice would be very much appreciated

  • Probably your situation is too specifically legal and contingent upon the terms of your lease for anyone to offer general opinion.

    You should consult with a local property solicitor.

    Go to a good property lawyer/solicitor a.s.a.p.
    It will take time.
  • Hinand thank you for your posts. as i thought, we already have a barester looking at our case. i was really looking for general dos and donts concerning the procedure. relating to if i landlord can create a flying freehold, as in my lease it states the landlord must not do anything to devalue the flat or building. creating a floating freehold has completly changed our building status, and most buyers would run a mile
