How do I work out my holiday entitlement?

Hi,

I'm just wondering if someone can help me out with working out how much holiday entitlement I'm due?

I work 31.5 hours a week over 4 days. My employer says I get 20.8 days rounded up to 21 days entitlement for the full year. I thought I'd be due 22.4 days (5.6 x 4). Has my employer worked it out a different way to me and are they right or am I wrong? Just a bit confused. :o

    What are the full time hours at your place of work?

    Are you hours spread evenly over the 4 days?

    Full time hours would be 39.5 hrs. I work 1 day 7.5 hrs and the other 3 days are 8 hrs a day.

    I would sayy you get 22.4 days like you think. Maybe ask them for the workings on how they get to that figure.

    Assuming that you get 28 days paid leave which *includes* bank holidays, then yes, you are right. It's 22.4.

    If not, tell me what your AL and BH arrangements are and I'll recalculate.

    My employer did say 23 days to begin with, then cameback to me with the 20.8 or 21 days. I did say I worked it out at 22.4 and was told how it was worked out very quickly, but didn't understand it tbh. My employment always work bank holidays and we don't get the extra days back. My employer did say something about that they always give us an extra 2 days off at xmas and new year too, while I was querying the AL figure. But regrardless of this then I would have thought they'd still need to give me my minimum AL entitlement.

    You aren't entitled to BHs off, just 28 days paid leave a year for full time work. That 28 can include the BHs, so you're not missing any holiday.

    Quite simply:
    28 x 0.8 (ie, 80% of full time work) = 22.4

    Or, if he wants to work it out in hours (slightly more accurate because you don't work 4 full days):
    28 / 39.5 (full time hours) = 0.7088
    0.7088 x 31.5 (your hours) = 22.33

    As long as you have that many days paid leave each year, then you're getting the right holiday, regardless of what your employer does with BHs.

    I would suggest writing to your employer by e-mail (keeping the evidence) and ask for clarification on how many a/l they think you are entitled to and explain how they have arrive at that figure.

    If this is different from your own account, set-up a meeting to discuss the difference.

    I've been in my current job for nearly 10 years. Not looked at my contract since I started the job, will see if I've still got it somewhere.
