    Also check the procedure for starting projects and seeing who exactly is responsible for ensuring that planning issues are sorted out before or during the build.

    It was indeed the director who hired a company to take soil samples following the planning permission report.

    The director should have waited for the results before renting out the building and ordering starting work.
  • So you need to ask the question why didn't he do this prior to the work being handed over to you - I suspect he will blame you for not ensuring it was done so you need to go through emails and find evidence that states you were forced to start this work without waiting and print them off now.

    Also when I asked why samples were being taken they just told me it was beccause of sewerage works. Still no mention of the known asbestos.

  • Ask why you have been kept in the dark; and I suspect that they will say 'who starts a job without reading the planning issues? It's your job to look into these things'. Hence finding something that tells you to start without following all the usual steps.

    Such roles and responsibilities are defined in the CDM regulations.
  • Update-

    Nothing much has happened since the last time we posted. My sisters disciplinary is Thursday next week. She is still waiting for the evidence which HR say will be sent next week.

    She has had spyrometey and ECG at the doctors but the doctor said its 20 years down the line that problems could occur, which we realise.
    We have also spoken to the CAB who suggested to ask for a compromise agreement as an option, but also to attend on Thursday to see what the employer has to say. So she is attending Thursday , so we will know more then.
    She is very nervous though.
