The owner of the building, in the way its up to a house owner to get permission for an extension on a house .

Before I manage the works its the responsibility of the building owner and the CDM co ordinator and also the H and S person to inform me of any issues.0 -

Ok.
The CDM and H&S people do not usually arrange for soil testing to be done prior to works starting. That's usually the job of the project engineers, to read the planning issues and act on them prior to works starting.
The owner employs a team of people, of which you are one. Hence you need to find out who is supposed to arrange for this as I suspect your name is going to be attached to this task and hence you are going to be the scapegoat. So get your thinking cap on!

No the LA asked the building owner to do this. So my company arranged for them to come and take them.
I found this out when the guy showed up to take them.0 -
Who in the company?
Was it the receptionist? Was it the cleaner? Was it your boss? Was it the person who should have done this prior to handing the job over?
You need to find out who did and who should have - as you are going to be accused of not doing it yourself and hence, you will be facing a breach of gross misconduct for not carrying this out or ensuring it had been carried out prior to starting the works.If you haven't got it - please don't flaunt it. You know what, I dont know exactly who but I am going to check this right now.
I have a feeling it could be the receptionist on order from the director to instruct a third party company to take them.0
