Hi I have had a Lloys TSB credit cards for years and have paid for PPI Insurance for years. I wrote to Lloyds using your standard letter asking for a copy of my CCA under section 78 of the consumer credit act. This morning I have received a response from them which basically states the following:-

I have enclosed with this letter copy of the reconstituted version of you agreement, a copy of you current terms and conditions and a signed statement of your account. By providing you with these documents we have satisfied our obligation under section 78. Ther is no requirement under the CCA to provide you with a copy of the original signed agreement. We are endeavouring to locate a copy of you signed agreement but please be assured we would not have opened a credit card account without having sight of a signed agreement.

Having satisfied our obligation under section 78 the agreement you have with us is fully enforceable and we shall treat it as such. We will not be entering into any further correspondence with you regarding the provision of copy agreements.

Ok what does this actually mean, where do I go from here, what is the next step I should be taking?

Any help or advice would much appreciated.

  • Firstly, why do you believe you were mis-sold the PPI? You need a valid reason.

    Secondly, if you have a valid reason then you don't really need to send off for any copies of anything.

    You just need to send them a letter stating your account details/card number, why you believe you were mis-sold the PPI and requesting the return of your premiums and interest. They then have 8 weeks to give you a final response - offer of refund, goodwill offer or rejection. After this if you're not happy you can take it to the Financial Ombudsman if you want to.

    There are templates for the mis-sale letter on this site or if you go to Lloyds website there are instructions there to fill out a form (it's the same one the Financial Ombudsman uses so it's fine). Personally I would keep everything in writing/recorded delivery and not ring them up to discuss any of it.

    If you really want to see all your records e.g. if you don't have statements and want to see how much PPI you've been paying etc. you can send them a Subject Access Request letter and a cheque for £10. They have 40 days to respond to this and it will (in theory) give you all your records going back 6 years and possibly beyond - but you don't need to do this to get your claim rolling, you just need a valid reason for a mis-sale and to ask for the money back.

    Thanks for that. Ok I have already called Lloyds direct and raised a complaint direct with them rather than use a midlle man, which they took over the phone, In the meantime I thought I should request a copy of the original documentation as I took it out so many years ago, and Im sure it was one of those forms that was sent with all the boxes ticked and just wanted to check. I haven't heard anything back from them and they didn't ask me to fill in a form or state they were sending a form for me to complete. Now I wish I'd used someone to do it for me. Guess I've just to sit tight now and wait. I will send the £10 and see what comes back, but its way longer than 6 years ago I took it out, more like 15. Jen

  • DON'T USE ANYONE TO DO IT FOR YOU!!!!!!!!!!!!!! Bunch of scammers, the lot of them, really, wipe that thought from your mind immediately!

    OK. When did you lodge your complaint over the phone? They have 8 weeks to give you a final response.
    What was the reason you gave for the mis-sale?
    Is your card still active? If not when did you close the account?
    And ignore the CCA response they sent you - it's just a standard response they send.

    I logged the complaint last week so yes they still have plenty of time to get back to me, I gave several reasons, the main being that I didn;t understand what PPI was and why I was taking it out but thought it was required. The card is still active and up to last week I was still paying the PPI - the lady told me that this would now be automatically cancelled as I have now raised a complaint. I haven't worked for at least 7 years and am now self employed so wouldn't cover me now anyway. Just owrried that I've cocked it up as not clued up on the jargon, hence the thought that I should have used a middle man. If I am refused can I then use someone to help out or is that it?

  • If you were told that the PPI was required and it wasn't then that is a mis-sale - tricky one to prove mind you but wait for their response. You can take it to the Financial Ombudsman if they turn you down and let them investigate it further - it's free, involves filling out one form and a big long queue. A claims company would not be able to make the queue move faster.

    That letter is fine, just change where it says LOAN to 'credit card' or 'account'. There will be other similar templates on this site somewhere too. Technically the SAR should produce a recording or transcript of your phone call with them when you put in your complaint, so you'll know exactly what was said. They have 40 days to respond in full to the SAR.

  • No, no need for a credit check unless you want to see your full credit details for some reason. All you'll get is a list of accounts you have with credit facilities, how much you currently have outstanding with each of them, if you're a good payer or a bad payer based on a monthly grading system over the last year, your electoral role details etc. Usually makes for quite dull reading! You can get a credit score to see how credit worthy you are as well, in case you're about to apply for more credit. Not relevant otherwise.
