Can I get a refund if I cancel Van hire?

    Dear me...

    No I booked a small van on website but I got an email from the company telling me it was unavailable. So I booked a larger one the same morning by phone but cancelled 20 mins later because I found another company had the van size I needed..

    Anyway thanks for all your help everyone - I have started the chargeback process and will let you know how I get on.

    However the moral of this story for anyone reading is :

    1: If you have paid for a van or car hire then you are NOT entitled to your money back under the law as you are not covered by the DSR.

    2: Pay always using your credit card.

    Hope it has helped someone and added to our collective consumer rights knowledge. Thank all :)

    Erm, i'm sure the moral of the story is actually

    shop around before entering into a contract and trying to cancel just hourse before you are due to pick up the vehicle

    Even if you paid by CC, doesn't mean you can claim a refund. They are equally liable for any breach of contract (including implied terms in law) made by the retailer -- not there to cover you if you change your mind.

    Sorry but I have to agree with above. I think you are on very rocky grounds with a chargeback. Not sure they have a reason category for 'the company wouldn't let me cancel to I would like to recover my money please'

    You won't get a charge back on your credit card, as you had an agreement with the hire company.

    The only way you could have got a refund was to hope that someone else hired the last medium sized van on that day, then phoned at just before the time you would have picked it up to see if one was available. If they'd said "no", then that meant they'd re-hired your van, so could only charge for expenses i.e. cost of refunding your deposit.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    That agreement has been rescinded and the hire company have offered a part refund. The dispute here is that the refund should have been total. As there appears to have been no clear terms implied, or explicit, regarding refunds, the card issuers would have to abide by their terms for chargeback and generally speaking, that would mean they would issue the chargeback.

    The bank may well issue a chargeback, it's likely though that the retailers merchant bank will decline it

    This is along the lines of what I have based the chargeback on. I am arguing that I was not advised about cancellation charges when booking.

    Anyway let's see...thanks for all your help and I will post back with any result.
