Payment Shield PPI mis-sold

In 1996 we applied for our first mortgage through an independent broker. Mortage was with Birmingham Midshires and part of package offered by the broker included Life Insurance and PPI.

The Broker no longer exists and we have since changed lender a few times but have continued to pay the PPI policy through payment shield.

I am wanting to claim back the PPI based on being ill advised that the PPI was compulsory with the mortage application. Being first time lenders we had agreed to this and completed all necessary paperwork.

We have never made a claim against this policy however 2 instances have been declined payout by payment shield a) 10 week absence from work following surgery b) Redundency

Appreciate some guidence on this matter and if there is a genuine claim to be made to have PPI refunded.

    You cant.

    1 - It is a verbal allegation to which you have no proof.
    2 - the broker doesnt exist anymore and its before regulation
    3 - you have given no indication that it there is a technical failing (i.e. not needed)

    Doent appear to a genuine complaint. Mortgage brokers are allowed to insist on you taking the insurance via them and the person you complain to no longer exists. Game over.

    Even if they did, you would not be able to take them to FOS over a 1996 sale and they could now rely on Section 14B of the Limitation Act 1980 to timebar a court case against them.
