Very urgent Help Please

My other half is currently coming to the closing stages of a legal battle. She injured herself at work at the Nhs and is in full swing of legal action.

The people she is suing have admitted 75% liability, but they are arguing the costs etc.

Her lawyer has just written stating that she has to get some legal cover, just in case they are unsuccesful. We are not currently covered on our house insurance, and they will not let us addon, as the case is already ongoing.

The Lawyer has given us a quote from Keystone Legal Benefits at a cost of £1600 plus insurance premium tax.

Does anyone know where we can go to get cover cheaper than this, with the acceptance that a legal battle is already in motion

The policy is a legal expense insurance policy that will cover disbursements & fees, also apparently covers the fees the Lawyer will incur to pursue her claim. The insurance will also cover any of her opponents costs that maybe awarded against her.

The premium of the insurance will be recoverable from the other side if the Lawyer is succesful with the claim. The payemnt for the policy is deferred until the end of the claim.

    Just a thought but what about legal expenses cover on your car insurance? Failing that what about Legal Aid?

    Legal aid is not available for personal injury cases any more.
  • and you can not add on to normal policies, car, contents etc, not when a case is in motion. I think what I am looking for is ATE insurance, after the event

    I think you should be asking questions about why this has been introduced so late in the day. If they required you to have such cover (not all solicitors do) they should have advised you at the outset of the case before any proceedings had commenced, when the cover would have been much cheaper.

    It may be worth asking for a copy of the firm's complaint procedure

    What you are looking for is after the event insurance. Unfortunately as it has been left so late where there is a known split in liability the premiums are going to be very high. Insurance is designed to cover the unknown but in this case the result is fairly well known... any premium is effectively going to be more or less the estimated cost based on a 75/25 settlement plus additional premium to cover the risk that something goes horribly wrong and settlement is on a worse basis etc.

    I forget about them all the time too even though I lived there for 6 years and generally go up at least every other week.

    Northern Ireland is very different to both Scotland and England/ Wales but I dont know about legal aid one way or the other.

    AFAIK, you wouldn't be responsible for the cost of the ATE Policy. That, along with the success fee, costs and disbursements will be recovered from the defending party (I take it this is the NHSLA) after the claim has settled.
