Ebay buyer threatening court action!!!

  • I think his email to you smacks of desperation and perhaps regret.

    As far as I see it from what you wrote, he came to your house and had the opportunity to inspect the item he purchased. It was shown to him that the item was in full working order.

    Whether he caused the crack or not I don't know. If he did cause the crack, then what he is trying to do is no different to buying a new car, driving it away from the dealership he bought it from, only to get a puncture just down the road (or a few turns away) and then trying to claim for a 50% reduction off the original price paid.

    With the above in mind the buyer is being completely unrealistic and I would assume needs to wake up and come out of the land of make-believe otherwise it could prove costly. Although I seriously think he is just making a threat with no intention of taking it to court. Over something so petty, it is not something you'd tell your mates/family about - at least not me anyhow :D

    He'd have to take you through the Small Claims Court, which I did with a fraudulent seller (an online shop) and it's a royal pain in the !!!! to go through the process, and you have to pay I think it's £35 upfront. Then if it's accepted it goes to the court (you don't have to attend) and a judge makes a decision. He would not win. Do keep copies of all his correspondence though, because if he did take you to court (which I think is unlikely) you may need to prove what has been going on. Keep everything as evidence. He would be very very unlikely to get a solicitor to take the case on over something so minuscule! I know it's stressful but there are good people out there selling on ebay - me for example! Hope it all works out.

    This is what makes eBay dangerous. Obviously the OP will ignore this guy but I think it's highly likely the buyer will turn up at the OP's address at some point dont you think?

    I for one dont need this hassle in my life which is why I would never allow some random person to come round to my house to collect. Its craziness!

    If you buy or sell on ebay then they can get your address if they wanted to anyway so regardless of if they call to collect or not the other party can still gain easy access to your address.

    Yes sure but this buyer is clearly gonna be !!!!ed off or difficult so slightly different to a normal transaction. Anonymosity is king when selling online.

    I would recommend your best option to be to totally ignore this idiot until you receive stamped court papers.
