replacing a faulty replacement item

My other half bought me expensive earphones in Dec 2010 costing over £50. In June'11 they developed a fault, I returned them to the shop and they were duly replaced and a new receipt given showing refund and replacement. A couple of weeks ago the replacement headphones developed exactly the same fault. Returned to the shop which is a reputable one, produced my replacement receipt and was told that I have to deal directly with the manufacturer. Told him my contract was with the store, so spoke with the Mgr who confirmed that because my original purchase was made in Dec'10 and the store cover faulty goods up to a year, I was now out of warranty with them but that the manufacturer covers up to 2 years and I must deal with them. I told him the replacement was less than 1 year old but he said the long and short is that the warranty start date remains at Dec'10 when they were originally purchased and not renewed from the date when they were replaced. We went round in circles getting nowhere so in the end I left with the contact details of the Manufacturer. Any comments would be gratefully received

    Technically you're right that your contract is with the shop. However, often it can save a lot of time and hassle to deal with the manufacturer directly and personally, if a retailer were refusing to deal with it......I would only try and enforce the issue if the manufacturer were going to charge me.

    Speak to the manufacturer and see what they say. If there are any problems, put your complaint in writing to the retailer. However, it is worth pointing out that you are past the 6 month point. It is a important point in a contract for the sale of goods as after 6 months have passed, the burden of proof lies with the consumer to prove that the item is inherently faulty and that the fault isnt due to misuse or normal wear & tear.


    Let us know how you get on with the manufacturer and if any further action is required, we can advise you better then :)

    Warranty is not extended by replacement - it is always the same period from the original receipt point no matter how many times its replaced during the warranty period.

    I would personally now deal with the manufacturer.
