Insurance and direct debit.

A tricky problem? Family member was Insured but failed to notice that direct-debits were not stopped. Didn't instruct bank.
If a car-insurance is canceled on the phone and the company keeps taking out the direct-debits for some months longer, before the insured person notices on his bank statements, can they expect the Company to refund the extra payments they took?
A further complication, if the Insurer says they did not receive the returned Certificate, what proof is required to show the car was not in insured's possession? Or does that make no difference?
The amount is about £250!
The Company argue it is not their responsibility.

Hi Northshore,
If there is no proof that the certificate was returned to the insurance company, then the only other way the money could be claimed back is to prove that the car wasnt in that persons posession, ie if it was sold, he would need to contact the previous owner and DVLA to comfirm when ownership was transferred to new owner, or if it was scrapped, then to get DVLA to confirm this.
Sometimes, Insurance Companies wont ask for this, but, most of the time they will cos lets face it, they wont want to give they money back.
Did this person buy another car? If so, did he have No Claims Bonus to transfer onto his new policy? If this is the case, then that should be able to confirm when the polciy should have been cancelled because you cant use the No Claims Bonus on 2 policies at the one time.
